General Terms and Conditions of Sports & Adventure Products GmbH & Co. KG (hereafter called Sports & Adventure Products)
1. Scope
We process your order according to our latest general terms and conditions which are effective at the time of your order. Our current general terms and conditions are available on our website www.kick-star.com under "General Terms and Conditions".
2. Contract Conclusion
You may order by phone, on our homepage (internet), by postcard, or by fax. With written orders without specification of the payment type, we reserve the right to send items via cash on delivery (see below).
By ordering the desired products, you agree to a binding contract conclusion. We are authorized to confirm this contract by sending you a confirmation of your order by post or by e-mail within 14 days. Your order can only be considered to have been accepted if you receive a confirmation of your order. If you do not receive a confirmation within 14 days, your order has not been accepted. Products which are not listed in the confirmation of your order are not included in the contract. Generally, your order will only be accepted if it exceeds our minimum order value of EUR 25,-.
3. Delivery
Within Germany, we usually deliver items that are in stock by mail within 3-5 weekdays. For international shipping within Europe, the delivery of available products will usually take 10-14 weekdays. The delivery time for international orders from outside of Europe depends on the dispatch type (air mail, surface) and the location of the receiver.
All of the above mentioned estimated delivery times are noncommittal unless they are explicitly agreed upon by us. If we have explicitly agreed upon a delivery time and the delivery is delayed, you can give us an extension of time which has to be at least two weeks. If this deadline is passed effectlessly, you are entitled to withdraw from the contract.
If for once an item is out of stock or is currently not available, we will tell you the delivery time as fast as possible or that the delivery cannot take place. We reserve a right to make a partial delivery if this supports a faster processing and if it is reasonable for you. If there is a partial delivery, we will naturally come up for any additional mailing expenses. In this case, there will be no additional costs for you.
If we are not able to deliver your order through no fault of our own because our contractor does not fulfill his contractual obligation, we reserve the right to withdraw from the contract.
4. Cancellation Terms and Conditions
You may revoke your contractual statement through a written text or by returning your order without giving reasons within two weeks after receiving your order and these cancellation terms and conditions in written form (e.g. letter, fax, e-mail). The time limit starts the day after receiving your order and these cancellation terms and conditions in written form. To adhere to this time limit, it is sufficient to mail the revocation or the order in time.

Cancellation Consequences
In the event of a valid revocation, each party shall return to the respective other party the benefits received. If you cannot at all return the benefits you received by us or only partially or in a worse condition, you will have to pay compensation for this. This does not apply for returns of benefits, when the degradation has been caused by an examination of the items which is likewise to the examination in a store. By the way, you can avoid compensation by not using the items like your own and by refraining from anything that can cause a degradation of the item’s value.
For returns, please use the enclosed return form and the original box. Also, please fill out the return form completely. Your right of withdrawal remains unaffected whether you use the return form and the original box or not.
If items are of poor quality or are not in accordance with your order, the right of withdrawal will not affect your right of warranty.
5. Prices
All indicated prices are in Euros and include VAT. Shipping and handling costs are added according to the terms listed below in number 6. and Shipping & Returns. Always prices from the latest catalogue apply.
6. Shipping and Handling (national)
In the following, you will find all information concerning shipping and handling costs for deliveries within Germany.
For each order, we charge no flat fee for packing and handling. Furthermore, we will charge no shipping fee according to the desired mail-order firm.
For payments by cash on delivery we will charge an extra fee in addition to the EUR 10, - for packing and handling and the shipping costs that depends on the country of delivery.
For technical reasons, it is not yet possible to set off collected deposits for orders via the internet.
7. Terms of Payment
We accept credit cards, EC cards, advance payment, or cash on delivery. It is not possible to pay on account. If you live outside of Germany, payment may only be possible with credit card or in advance.
a) Payment with Credit Card
We accept VISA or EURO-/MASTERCARD. You need to give us the number, card verification code (CVC2)*, and expiration date of your credit card. *You can find the card verification code (CVC2) on the back of your credit card. It consists of three digits and follows the 16 digits of your credit card number.
b) Payment in Advance
We will send you a confirmation of your order by e-mail. After receiving your payment, we will send you your order. Please wait for the confirmation of your order before paying!
c) Cash on Delivery
Payment is made when the order is delivered.
8. Warranty
Warranty complies with legal requirements. For complaints, the date of purchase has to be proven with a receipt. Together with a copy of the receipt the article which is complained needs to be sent to the following address:

Regular wearout of the items does not account for a warranty claim.
If items of your order have a material defect according to legal requirements, we are bound to do a supplementary performance as long as we are not obliged to refuse a supplementary performance by legal regulations. Furthermore, you have to grant as an additional time for the supplementary performance. It is your choice to get either the defect removed or a new delivery.
If we have tried for supplementary performance in vain two times, it is considered as failed. If the supplementary performance has failed or it is unacceptable for you, you may either reduce the purchase price or withdraw from the contract or ask for compensation.
Your right to claim further compensation to the following conditions remains unaffected.
According to legal requirements, we are liable for damage on your life, body, or health without restrictions that are caused by a blameworthy breach of duty by us, our legal representatives, or our assistants. Moreover, we are liable without restrictions for damages that are included in the Product Liability ACT and for all damages that are caused by intentional or grossly negligent contract violations or fraudulent intent by us, our legal representatives, or our assistants. We are also liable in the context of a warranty of quality and/or durability if we have issued it for the items delivered. Also, according to legal requirements, we are liable without restrictions for damages that occurred due to a negligent violation of an essential contractual obligation.
Independent of the legal character of claims, there do not exist any further liability claims against us.
9. Care
Please note the instructions for use as described in the manual. We do not cover any damages caused by wrong handling.
10. Reservation of Proprietary Rights
All delivered items remain in our property until they have been completely paid for.
11. Storage of Data
Sports & Adventure Products GmbH & Co. KG does strictly observe data protection. You agree to the storing, processing, and using of your personal data, which has been forwarded with your order, to carry out your order according to the Federal Data Protection Act. Your stored personal data is only passed on to a transport company to deliver your order. Of course, all personal information is regarded as confidential.
For marketing purposes, we associate with other mail order and service businesses. If you agree to this, your personal data will be passed on to these businesses. In this process, your private interests are completely considered.
12. Right of Objection According to the Federal Data Protection Act
According to the Federal Data Protection Act, persons concerned have a right of objection to the use or transmission of their data for advertising purposes (block indicator). In addition to this, there exists a right of information and, under certain circumstances, a right to correct, block, or delete personal data which is stored by us.

Shipping & Returns
Shipping and Handling (international)
In the following, you will find all information concerning shipping and handling costs for international deliveries.
We will charge 25,00 EUR for shipping inside the EU except for the following countries: Bosnia and Herzegovina, Croatia, Serbia, Bulgaria, Romania, Greece, Iceland.
For shipping to Bosnia and Herzegovina, Croatia and Serbia we will charge 50,00 EUR,
for shipping to Bulgaria, Romania, Greece and Iceland we will charge 70,00 EUR
For payments by cash on delivery we will charge an extra fee in addition to the EUR 10,- for packing and handling and the shipping costs that depends on the country of delivery. For technical reasons, it is not yet possible to set off collected deposits for orders via the internet.
Returns Policy
Within Germany:
You may return all items within 14 days of delivery for a full refund. The process of refunding might take up to 20 days after receiving your return parcel.
You may send back your items free of charge. For this, please use the shipping label that is enclosed in your order.
Please send back items in their original wrappings and use a cardboard box, so they will not be damaged.
International returns:
When returning items from abroad, customers will have to pay for shipping costs if the delivered items match the order. For international returns, please make sure that you stamp your return parcel correctly. If returns are not stamped correctly, we reserve the right to take incurred expenses off the refund amount.
Of course, international orders may be returned within 14 days of delivery as well. If you are not satisfied with our products, you will get your money back. The process of refunding might take up to 20 days after receiving your return parcel.
